I expect the Democratic AGs to ball this EO up and use it to line birdcages. The order unconstitutionally strips states of their authority to run their own elections. But for now, a Trump-appointed judge declined to block it, allowing implementation to move forward while litigation plays out.
That’s not the only case to watch. A separate coalition lawsuit — also filed in Boston, also arguing the order violates the Constitution’s Elections Clause — is scheduled to be heard on June 2nd by U.S. District Judge Indira Talwani, an Obama appointee. Her ruling could conflict with what we’re seeing out of other courts.
If these cases split, or if an injunction gets appealed fast enough, we could be looking at a Supreme Court showdown before the midterms.
